We take your privacy very seriously. Please read this privacy policy carefully as it contains important information on who we are, how and why we collect, store, use, and share your personal information. It also explains your rights in relation to your personal information and how to contact us or supervisory authorities in the event you have a complaint.

We collect, use and are responsible for certain personal information about you. When we do so we are subject to various laws in the United States and the General Data Protection Regulation which applies across the European Union (including in the United Kingdom), and we are responsible as “controller” of that personal information for the purposes of those laws.

This privacy policy covers all interactions with any services offered by Brickadia, LLC.

  3. Personal information we collect about you. We may collect and use the following personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household:

    • If registering on our website, we collect your username, email address, and password.
    • If registering through Steam, we collect your username and Steam user id.
    • If registering through Epic Games, we collect your username and Epic user id.
    • This information is retained while you have an account.

    Information about login sessions.

    • Every time you login to our services, we create a login session. For this purpose, we collect your IP address, the approximate location derived from your IP address, and the first/last time the session was accessed.
    • You can view a list of your existing sessions on your profile to check for unrecognized activity or manually delete sessions you no longer need.
    • Sessions are automatically deleted after 3 months of inactivity.

    Information about your online status and play time.

    • While a game login session is active, we increase a total playtime counter on your profile.
    • You may choose to publicly display your online status, current game server, and play time using the privacy settings in your account settings. Otherwise, it is only displayed to you.
    • Only the last online time and total playtime is retained, other online status information is deleted once you disconnect from the services.

    Optional profile information.

    • You may voluntarily submit additional profile information, such as an avatar, your gender, location, and bio. This is not required to use the services.
    • You can control who sees this information using the privacy settings in your account settings.

    User trust information.

    • You may voluntarily “trust” other users, potentially granting them additional permissions in your game servers (depending on permission configuration) or allowing them to view additional information about your profile (depending on privacy settings).
    • You may view a list of your trusted users, and users that trust you, in your account settings.
    • Trust information is retained until you remove the user from your trust list.

    Information about game servers.

    • If you decide to host a game server, we collect your IP address, the name of the server, a visitor counter, and optionally a description.
    • If you choose to publicly list the server for other users to join, this information will be shared with all other users.
    • This information is automatically deleted after 3 days of inactivity.

    Information about connections to game servers.

    • While you are connected to a game server, we collect your user id and the server id to store a temporary play session that is regularly refreshed.
    • This ensures that unauthorized clients using your account are kicked from servers if you delete the corresponding login session in your account settings.
    • This data is automatically deleted when you disconnect from the game server.

    Information about gallery creations.

    • If you share a creation on the gallery, we collect your user id to associate it with, as well as any other user ids who you may specify as collaborators. These are displayed publicly.
    • This information is retained until the creation is deleted.

    Information about crash reports.

    • If your game crashes, you will see a window asking you to submit a crash report. This process collects information that may help fix the bug: your user id in case we want to contact you about the crash, metadata about the crash itself, your computer hardware, the current state of the game, and optionally log files.
    • Crash reports are aggregated into groups by their call stack, and information submitted is only used for fixing the bug.
    • Crash reports are automatically deleted after 30 days.

    Information about user reports.

    • We provide ways for users to report violations of the fair play rules by other users. When you file such a report, we collect your user id, the reported user id, and the content of the report.
    • We may delete this information at any time, for example after we consider the report resolved or no longer relevant.

    Information about moderation tickets.

    • We provide a Discord bot for you to message the volunteer moderators of our Discord community with various concerns or questions you have. When such a ticket is filed, we collect your Discord user id and the content of the ticket.
    • We may delete this information at any time, for example after we consider the ticket resolved or no longer relevant.

    Information about blog subscriptions.

    • When you subscribe to our development blog, we collect your email address to send you the notifications you requested.
    • This information is retained until you unsubscribe from the blog website or one of the emails you received as part of the subscription.

    This personal information is required to provide Brickadia Services to you. If you do not provide personal information we ask for, it may delay or prevent us from providing Brickadia Services to you.

    We generally don't collect information that is not needed to operate the platform.

  5. How your personal information is collected. We collect most of this personal information directly from you. However, we may also collect information:
    • From publicly accessible sources;
    • From a third party with your consent;
    • From other users as part of our moderation process;
    • When directly initiated by you.
  6. How and why we use your personal information. Under data protection law, we can only use your personal information if we have a proper reason for doing so, e.g.,:
    • To comply with our legal and regulatory obligations;
    • For the performance of our contract with you or to take steps at your request before entering into a contract;
    • For our legitimate interests or those of a third party; or
    • Where you have given consent.

    A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

  7. Promotional communications. We may use your personal information to send you updates (by email) about our products and/or services, including exclusive offers, promotions or new products and/or services.
  8. We have a legitimate interest in processing your personal information for promotional purposes (see above: “How and why we use your personal information”). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.

    We will always treat your personal information with the utmost respect and never sell or share it with other organizations outside Brickadia, LLC. for marketing purposes.

    You have the right to opt out of receiving promotional communications at any time by using the "unsubscribe" link in promotional emails or unsubscribing online.

    We may ask you to confirm or update your marketing preferences if you instruct us to provide further products and/or services in the future, or if there are changes in the law, regulation, or the structure of our business.

  9. Who we share your personal information with. We routinely share personal information with:
    • Service providers we use to help deliver our products and/or services to you;
    • Other third parties we use to help us run our business, such as marketing agencies or website hosts;
    • Third parties approved by you, including social media sites you choose to link your account to or third-party payment providers;

    We currently use the following third party service providers:

    • We persistently store user data on servers provided by Hetzner, a hosting provider headquartered in Germany, who is subject to strict privacy standards.
    • We use the Cloudflare reverse proxy for securing our website and API services against attacks, improving the performance, and providing CDN services.
    • If you host or connect to a game server using EOS networking, we share your IP address and user id with Epic Games to create the connection.
    • If you host or connect to a game server using Steam networking, we share your IP address and user id with Steam to create the connection.
    • If you connect to a game server using direct connection, we share your IP address and user id with the host of the server to create the connection.
    • If you send us a crash report, they will be stored and processed by Bugsplat.
    • If you send us emails, they will be stored and processed by Microsoft 365.
    • If you subscribe to the blog, emails are sent by Mailgun.

    We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information.

    We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.

    We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

    We will not sell or share your personal information with any other third party.

  10. Where your personal information is held. Information may be held at our offices, third party agencies, service providers, representatives and agents as described above (see above: “Who we share your personal information with”).
  11. How long your personal information will be kept. We will keep your personal information while you have an account with us or while we are providing products and/or services to you. Thereafter, we will keep your personal information for as long as is necessary:
    • To respond to any questions, complaints or claims made by you or on your behalf;
    • To show that we treated you fairly; or
    • To keep records required by law.

    We will not retain most personal information for longer than necessary for the purposes set out in this policy. Different retention periods apply for different types of personal information (see above: “Personal information we collect about you”).

  12. Keeping your personal information secure. We have appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorized way.
  13. We limit access to your personal information to those who have a genuine business need to access it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality.

    We have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

    We limit access to the servers and databases to only specific staff who have a technical need to access them. All communication between the game client and our services is securely encrypted using modern standards.

    Please note that we are not required to:

    • Retain any personal information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained; or
    • Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information;
    • Provide the personal information to you more than twice in a 12-month period.

    Personal Information Sold or Used for a Business Purpose

    In connection with any personal information we may sell or disclose to a third party for a business purpose, you have the right to know:

    • The categories of personal information about you that we sold and the categories of third parties to whom the personal information was sold; and
    • The categories of personal information that we disclosed about you for a business purpose.

    Right to Deletion

    Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

    • Delete your personal information from our records; and
    • Direct any service providers to delete your personal information from their records.

    Please note that we may not delete your personal information if it is necessary to:

    • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
    • Debug to identify and repair errors that impair existing intended functionality;
    • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
    • Comply with the California Electronic Communications Privacy Act;
    • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
    • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
    • Comply with an existing legal obligation; or
    • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

    Protection Against Discrimination

    You have the right to not be discriminated against by us because you exercised any of your rights under the CCPA. This means we cannot, among other things:

    • Deny goods or services to you solely for requesting your CCPA rights be exercised;
    • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
    • Provide a different level or quality of goods or services to you; or
    • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

    Please note that we may charge a different price or rate or provide a different level or quality of goods and/or services to you, if that difference is reasonably related to the value provided to our business by your personal information.

  18. How to exercise your rights. If you would like to exercise any of your rights as described in this Privacy Policy, please:
    • Email us at [email protected] from the exact verified email address currently linked on your account. If you do not yet have an email linked, such as because your account was registered through Steam or Epic Games, you may first link one in your account settings.
    • Email us at [email protected] and provide verifyable proof of ownership of a linked account such as Steam, or some other way to verify your identity.

    If you choose to contact directly by email, you will need to provide us with enough information to verify your identity and a description of what right you want to exercise and the information to which your request relates.

    If you do not have a Brickadia account, we typically do not store any personal information about you. If you believe we do, you may email us anyway.

    Please note that you may only make a CCPA-related data access or data portability disclosure request twice within a 12-month period.

    We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information, or is someone authorized to act on such person’s behalf.

    Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.

  19. How to file a GDPR complaint. We hope that we can resolve any query or concern you raise about our use of your information.
  20. The General Data Protection Regulation also gives you the right to lodge a complaint with a supervisory authority, in the European Union (or European Economic Area) state where you work, normally live, or where any alleged infringement of data protection laws occurred.

  21. Information out of scope of this privacy policy. This privacy policy only applies to the personal information we collect and process through our services. Here are some examples of information that is not covered by this policy:
